Terms of Service

The rules for using Chozea as a creator, brand, or visitor.

Acceptance of these terms

These Terms of Service govern access to chozea.com and Chozea's creator marketplace. By creating an account or using Chozea, you agree to these terms and the policies linked from them. If you do not agree, do not use the platform.

Eligibility and account security

You must be legally able to enter agreements and provide accurate, current account information. You are responsible for safeguarding your login credentials and activity under your account. Tell support@chozea.com promptly if you suspect unauthorized access.

Chozea's marketplace role

Chozea is a technology marketplace connecting creators and brands. Chozea provides matching, campaign, application, messaging, deal, project, payment, payout, and workflow tools. Brands and creators make their own collaboration decisions.

Creators are independent service providers. Using Chozea alone does not make a creator an employee, partner, agent, franchisee, or representative of Chozea.

User responsibilities

  • Creators must provide accurate profiles, portfolios, applications, availability, and deliverables.
  • Brands must provide accurate brand and campaign information, lawful products or services, and truthful claims.
  • Each user must review deal terms before accepting them and communicate respectfully through Chozea.
  • Users must meet advertising disclosures, intellectual-property obligations, taxes, and other laws that apply to them.

Deals and collaboration terms

Accepted deal terms govern the specific collaboration, including compensation, deliverables, deadlines, revisions, usage rights, licensing, posting requirements, raw footage, content length, platforms, and campaign obligations. Users are responsible for reviewing those displayed terms before agreeing.

Fees, payments, and payouts

Creators currently pay a 0% Chozea platform fee and keep 100% of their agreed creator compensation. Taxes, payment processor charges, bank fees, currency conversion, and legally required deductions may still apply.

Brands currently pay a 10% Chozea platform fee. Applicable third-party processing charges are disclosed separately where relevant. A project must be funded before work begins. Creator payout becomes eligible only after applicable project requirements are satisfied and payment is eligible for release.

Processor timing, bank processing, verification, fraud or security review, legal requirements, or payment disputes may affect payout timing.

Cancellations, refunds, and disputes

Before work begins, eligible funded projects may be cancelled and refunded through Chozea's process. Once work begins, there is no automatic refund; the matter moves to manual resolution. The Refund Policy and Dispute Policy explain the process.

Intellectual property and licenses

Users retain ownership of content they provide except for rights they expressly grant. Deal-specific terms determine creator ownership, brand usage rights, licenses, platforms, duration, posting requirements, and delivery of raw materials. Users must have the rights needed for content they upload or use.

Acceptable conduct

  • Do not commit fraud, impersonate others, manipulate payment or matching records, or evade platform safeguards.
  • Do not harass, threaten, exploit, or pressure another user.
  • Do not publish illegal content, infringe rights, make misleading claims, or promote unlawful products or services.
  • Do not interfere with platform security, scrape restricted information, or misuse another person's private information.

Suspension and termination

Chozea may restrict, suspend, or terminate access where reasonably necessary for safety, fraud prevention, legal compliance, repeated policy breaches, nonpayment, or misuse. Existing obligations, payment records, accepted terms, and provisions intended to survive termination remain applicable.

Third-party services and availability

Chozea relies on third-party services, including Stripe for payment processing and connected payout accounts. Their terms and verification requirements may apply. Chozea may change, suspend, or experience interruptions in platform availability and does not promise uninterrupted operation.

Disclaimers

Chozea provides marketplace software and assistance on an as-available basis. Chozea does not promise creator performance, campaign success, brand sales, follower growth, income, reach, engagement, payment timing, creator suitability, or that AI-assisted output will be accurate or appropriate.

Limitation of liability

To the maximum extent permitted by applicable law, Chozea is not liable for indirect, incidental, special, consequential, exemplary, or punitive losses, or lost profits, data, goodwill, or opportunities arising from platform use. Any limitation applies only to the extent permitted by law and does not exclude liability that cannot legally be excluded.

Indemnification

To the extent permitted by law, you agree to be responsible for claims and reasonable costs arising from your unlawful conduct, your content, your breach of these terms or accepted deal terms, or your infringement of another person's rights.

Dispute process and updates

Users should first use Chozea messaging, then contact support@chozea.com. Payment matters may be sent to payments@chozea.com. The internal process does not remove legal rights available under applicable law.

Chozea may update these terms. Material updates will be presented through reasonable platform notice, and the updated date will change. Continued use after an update takes effect indicates acceptance where permitted by law.
